Terms and Conditions

Effective Date: September 4, 2026
Last Updated: September 4, 2026

Welcome to DWS Fencing (dwsfencing.com). These Terms and Conditions govern your use of our website and services. By accessing our site, requesting a project estimate, or hiring us for fence construction, you agree to comply with and be bound by the following terms. Please read them carefully.

1. Services and Scope of Work

DWS Fencing provides professional fence installation, building, and repair services throughout Northwest Houston and surrounding communities.

All project descriptions, material specifications, and installation timelines provided on this website are for informational purposes.

A verbal or written agreement made via text message or email detailing the exact scope of work and material selections (e.g., Western Red Cedar, pressure-treated pine) will establish the project terms.

2. Estimates and Pricing

Project Quotes: Any initial estimates or quotes requested through our website form, email, or telephone are based on preliminary project details.

Quote Changes: Physical property constraints, hidden underground obstacles, utility line layouts, zoning/covenant restrictions (such as The Woodlands Township guidelines), or fluctuating material costs may affect the original estimate. If there is any change to the initial quote, it will be communicated to the customer for approval first before any extra work is performed or billed.

3. Homeowner Responsibilities

For any fence installation project initiated through our services, the property owner is responsible for:

Assisting with or providing accurate property line parameters.

Securing necessary approvals from Homeowners Associations (HOAs) or local municipal architectural committees, unless explicitly agreed upon via text or email that DWS Fencing will handle the submission.

Clearing the immediate installation path of obstructions, landscaping, or debris prior to the scheduled start date.

4. Communication and SMS Consent

By submitting your contact details, phone number, or physical project address through our web contact forms, you agree that DWS Fencing may contact you via phone call, email, or text messaging (SMS) to discuss your estimate, schedule site visits, or send installation updates.

Message and data rates may apply depending on your mobile carrier.

You may opt out of receiving text messages at any time by replying STOP to any mobile message received.

5. Intellectual Property

All content on this website—including text descriptions, custom graphics, logos, and project showcase photography of our custom privacy or ranch-style fences—is the exclusive property of DWS Fencing. You may not copy, reproduce, or redistribute any website content without our express prior written consent.

6. Limitation of Liability

DWS Fencing, its owners, and its builders shall not be held liable for any indirect, incidental, or consequential damages resulting from your use of this website, information gaps in website text, or temporary inability to access our online services.

7. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Texas. Any disputes arising from your use of this website or our services shall be subject to the exclusive jurisdiction of the state and federal courts located in the Greater Houston area.

8. Natural Characteristics of Wood and Weathering Disclaimer

Wood is a natural product subject to environmental and climate variations. By choosing a wood perimeter (including premium Western Red Cedar and pressure-treated pine), the customer acknowledges and accepts the following natural characteristics of exterior timber:

Color Changes (Graying): Ultraviolet (UV) rays from the Texas sun will naturally cause all untreated wood fences to gradually weather from their original amber or golden tones into a silver-gray patina over time. This is a purely cosmetic change and does not indicate structural failure or rot.

Checking and Splitting: As wood adjusts to fluctuating local humidity and intense heat, surface cracks (known as "checking") may develop along the grain. This is a natural seasoning process caused by the wood expanding and contracting as it dries and absorbs moisture. These surface splits are cosmetic and do not affect the structural integrity of the fence panels or posts.

Warping and Twisting: Minor twisting, bowing, or warping of individual pickets, rails and occasionaly a post can occur as lumber acclimates to the environment. DWS Fencing selects high-quality materials, but natural shifting after exposure to heavy rain and high heat and humidity is normal and not a defect in craftsmanship.

Staining and Maintenance: To preserve the original color of your cedar or pine fence and delay the natural graying process, DWS Fencing highly recommends applying a professional-grade UV-inhibiting stain or sealant after the wood has fully acclimated. Regular maintenance is the responsibility of the homeowner.
